• Conduct security testing and validation within your authorized environment

3. Prohibited Activities

You agree NOT to use our Services to:

3.1 Illegal Activities

• Violate any applicable laws, regulations, or legal obligations
• Facilitate, promote, or engage in illegal activities
• Infringe upon intellectual property rights of others
• Engage in fraud, money laundering, or financial crimes

3.2 Malicious Activities

• Launch or facilitate cyberattacks, denial of service attacks, or other malicious activities
• Distribute malware, viruses, ransomware, or other harmful code
• Conduct unauthorized penetration testing or security assessments on third-party systems
• Circumvent security measures of our Services or other systems
• Use our Services to attack, compromise, or harm other systems or networks

3.3 Abuse and Harassment

• Harass, threaten, stalk, or harm others
• Distribute hate speech, discriminatory content, or incite violence
• Impersonate any person or entity, or falsely state affiliation
• Violate privacy rights or unlawfully collect personal information

3.4 Unauthorized Access

• Access or monitor systems, networks, or data without proper authorization
• Share account credentials or allow unauthorized access to your account
• Bypass authentication, access controls, or security mechanisms
• Scrape, crawl, or extract data from our Services using automated means

3.5 Service Abuse

• Overload, disrupt, or degrade the performance of our Services
• Consume excessive resources or create unreasonable loads on infrastructure
• Reverse engineer, decompile, or attempt to extract source code
• Remove, obscure, or alter any proprietary notices or labels
• Use Services for purposes outside the scope of your license agreement

3.6 Competitive Activities

• Use our Services to develop competing products or services
• Benchmark our Services for competitive purposes without written permission
• Copy features, functionality, or user interfaces for competitive products

3.7 Data Misuse

• Process or store illegal content, child exploitation material, or terrorist content
• Use Services to facilitate spam, phishing, or fraudulent communications
• Store or transmit data in violation of third-party rights or contracts
• Export controlled information in violation of export control laws

4. Security Testing and Research

Security research and testing are permitted under the following conditions:

• Authorized Scope: Testing limited to your own account and authorized resources
• No Disruption: Testing must not disrupt Services for other users or degrade performance
• Responsible Disclosure: Security vulnerabilities must be reported to security@guardaxion.com
• No Public Disclosure: Do not publicly disclose vulnerabilities before we have addressed them
• Good Faith: Testing conducted in good faith to improve security, not to harm or exploit

5. Resource Usage Limits

To ensure fair access for all users, we enforce the following:

• API Rate Limits: Requests per second/minute/day based on your subscription tier
• Storage Quotas: Data retention limits for logs, analytics, and configuration data
• Concurrent Connections: Maximum simultaneous connections and sessions
• Batch Processing: Limits on bulk operations and data imports

6. Monitoring and Enforcement

GuardAxion reserves the right to:

• Monitor use of Services to ensure compliance with this AUP
• Investigate suspected violations and potential security incidents
• Suspend or terminate accounts that violate this AUP
• Remove or disable access to content that violates this AUP
• Cooperate with law enforcement and regulatory authorities
• Take legal action against violators to protect our rights and users

We will make reasonable efforts to notify you before taking enforcement action, except where immediate action is necessary to protect security, prevent harm, or comply with legal obligations.

7. Reporting Violations

If you become aware of violations of this AUP, please report them immediately:

8. Consequences of Violations

Violations of this AUP may result in:

• Warning: Written notice of violation with requirement to cease prohibited activity
• Temporary Suspension: Account access suspended pending investigation or remediation
• Service Limitation: Restricted access to certain features or reduced usage quotas
• Account Termination: Permanent termination of account and access to Services
• Legal Action: Civil or criminal proceedings for serious violations
• No Refund: No refunds for accounts terminated due to AUP violations

The severity of consequences depends on the nature and severity of the violation, prior violations, and potential harm caused.

9. Third-Party Services

If you integrate GuardAxion with third-party services or AI platforms:

• You are responsible for compliance with third-party terms of service
• You must have proper authorization to monitor and control access to third-party services
• You agree not to violate rate limits, terms, or policies of third-party platforms
• GuardAxion is not responsible for third-party service availability or compliance

10. Data Protection and Privacy

When using our Services:

• Comply with applicable data protection and privacy laws (GDPR, CCPA, etc.)
• Obtain necessary consents for monitoring and processing personal data
• Implement appropriate safeguards for sensitive and regulated data
• Do not process data in ways inconsistent with your privacy policies
• Notify affected individuals of data breaches as required by law

11. Export Compliance

You agree to comply with all applicable export control and sanctions laws:

• Do not use Services in embargoed countries or for prohibited end uses
• Do not provide access to Services to restricted parties or entities
• Do not export technical data in violation of export control regulations

12. Changes to This Policy

We may update this AUP periodically. Material changes will be communicated via:
